| dc.description | The present Thesis titled Breach of State for the Comprehensive Protection of juvenile offenders, the stated goal was the reform of Article 193 by adding a numeral of the Code of Children and Adolescents was conducted following the guidelines given by the University Quevedo State Technical School of Law. Proceeded to an analysis of the problem, the history of research, teaching, law, law and comparative law research topic, to formulate the hypothesis and define the field research. In the theoretical framework, it became a law of the subject of study, which determines the inefficiency of the State Comprehensive protection measures to juvenile offenders. The field research by surveying studen of Canton Quevedo and abogation with the judges of the Family, Women, Children and Adolescents of the Provincial Court of Justice of the Rivers and Latacunga, Cantons de Quevedo and Mana respectively, I served to get to show that the hypothesis is positive. The law firm of juvenile offenders and the field research and the methods used, conclude that it must amend Article 193 of the Code of Childhood and Adolescence adding an item to ensure the effective enjoyment of the full protection that have children and adolescents, in chapter V and VI develop conclusions and recommendations and the proposal | es_ES |
| dc.description.abstract | La presente Tesis de grado cuyo título es Incumplimiento del Estado respecto de la protección Integral de los adolescentes infractores, el objetivo planteado fue la reforma al artículo 193 agregando un numeral del Código de la Niñez y Adolescencia, se realizó siguiendo las directrices dadas por la Universidad Técnica Estatal de Quevedo, Facultad de Derecho. Procedí a realizar un análisis del problema, de los antecedentes de la investigación, doctrina, jurisprudencia, legislación y derecho comparado del tema investigado, para formular la hipótesis y definir la investigación de campo. En el marco teórico, se hizo un estudio jurídico del tema de estudio, donde se determina la ineficiencia del Estado en aplicar medidas de protección Integral a adolescentes infractores. La Investigación de campo mediante encuestas a los estudiantes y abogados del Cantón Quevedo y entrevistas a los Jueces de la Familia, Mujer, Niñez y Adolescencia de la Corte Provincial de Justicia de los Ríos y Latacunga, Cantones de Quevedo y la Maná respectivamente, me sirvieron para llegar a demostrar que la hipótesis planteada es positiva. El estudio jurídico de los menores infractores y, la investigación de campo y, los métodos utilizados, concluyen que se debe reformar el artículo 193 del Código de la Niñez y adolescencia agregando un artículo a fin de garantizar el efectivo goce de la protección integral que tienen los niños, niñas y adolescentes, en los capítulo V y VI se desarrollan las conclusiones y recomendaciones y la propuesta | es_ES |
