| dc.description | This legal research, entitled "The powerless absolute impediment of marriage, affect the rights and freedoms of individuals" was the result of a thorough analysis of the regulatory provisions of the Civil Code concerning the rights of powerless people, a situation that nullity because the marriage contracted by these people, a constitutional right is violated by Article 95, no. 4 of the Civil Code, where it is discriminated against by their health status, and thus their right to form a family through adoption, as well as the right to test or bequeath your estate to your heirs. The research objectives guided the entire research process literature, and the hypothesis, the field research process. Results that were obtained by conducting surveys and interviews, data and information that allowed confront the hypothesis, namely: "The reform of the Arts. 95 and 102 of the Civil Code regarding the impediments dissolving marriage and the feasts of the same, will prevent the infringement of the rights and freedoms of individuals powerless to be considered equal before the law ", was positive, it was shown that such precepts law should be reformed to avoid infringement of the constitutional rights of powerless people. The proposed legal reform to Article 95 and 102 of the Civil Code, in sections above, aims to forewarn that the constitutional right to non-discrimination of persons is violated by lower-level rules that contravene express constitutional provisions, as all before the law enjoy equal rights and opportunities. | dc.description.abstract | La presente investigación jurídica, tulada “El impedimento dirimente del impotente en el matrimonio, afecta los derechos y libertades de las personas” fue el resultado de un detenido análisis de los preceptos normativos del Código Civil respecto a los derechos de las personas impotentes, situación que causa nulidad al matrimonio contraído por estas personas; un derecho constitucional que es vulnerado por el Art. 95, núm. 4 del Código Civil, donde se lo discrimina por su situación de salud, y con ello de su derecho a formar una familia mediante la adopción, así como del derecho a testar o legar su patrimonio a sus herederos. Los objetivos de la investigación guiaron todo el proceso de investigación bibliográfico; y la hipótesis, el proceso de investigación de campo. Resultados que se obtuvieron mediante la aplicación de encuestas y entrevistas, datos e información que permitieron confrontar la hipótesis planteada, a saber: “La reforma a los Arts. 95 y 102 del Código Civil respecto a los impedimentos dirimentes del matrimonio y de las solemnidades del mismo, evitará que se vulneren los derechos y libertades de las personas impotentes a ser considerados iguales ante la ley”, resultó positiva, pues se demostró que tales preceptos jurídicos deben reformarse para evitar que se vulneren los derechos constitucionales de las personas impotentes. La propuesta de reforma jurídica a los Art. 95 y 102 del Código Civil, en los numerales mencionados, tiene como fin precautelar que el derecho constitucional a la no discriminación de las personas sea vulnerado por normas de menor jerarquía que contravienen expresas disposiciones constitucionales, pues todos ante la ley gozamos de iguales derechos y oportunidades. La condición de salud de los impotentes no puede ser objeto de sanción, como en efecto es, al ser considerado nulo el matrimonio contraído con estas personas. | es_ES |
