| dc.description | The destruction of the environment, due to indiscriminate logging and destruction of Flora and Fauna, is one of the most critical problems in the world and that is why there has been a need for awareness in the search for alternatives solution. For with the passage of time there runs the danger that the earth will suffer irreversible magnitudes with mortal danger to humanity. The catastrophe of the environment, due to indiscriminate logging, destruction is growing fast and soon it will be too late to stop the environmental imbalance, the main responsible are human beings, destroying forests and tropical forests, negatively altering the Atmosphere and the balance of the earth. The Ecuadorian State has the Environmental Management Law, which does not criminally criminalize or contravene; It being necessary for the National Assembly to reform COIP in its article 246 with a penalty of deprivation of liberty so as to respect the rights and principles enshrined in the Constitution of the Republic of Ecuador 2008, it for part established the responsibility in the management of nature is of the State, however, the same Constitution prescribes the Right of Repetition, so that they respond for their actions and omissions, Therefore, the responsibility rests with all the institutions of the public sector and in general it is the responsibility of all the citizens that we live in the Ecuadorian territory. | dc.description.abstract | La destrucción del Ambiente a causa de la tala indiscriminada y destrucción de la Flora y la Fauna, constituye uno de los problemas más críticos en el mundo, es por ello que ha surgido la necesidad de la toma de conciencia en la búsqueda de alternativas de solución. Sin embargo, con el paso del tiempo se corre el peligro que la tierra padezca afectaciones irreversibles con peligro mortal para la humanidad. La catástrofe del Ambiente, a causa de la tala indiscriminada, crece en forma acelerada y dentro de poco tiempo será muy tarde frenar el desequilibrio ambiental. Los principales responsables somos los seres humanos, al destruir las selvas y bosques tropicales, alterando negativamente la atmósfera y el equilibrio de la tierra. El Estado Ecuatoriano cuenta con La Ley de Gestión Ambiental, misma que no tipifica en forma taxativa delitos ni contravenciones; siendo necesario que la Asamblea Nacional, reforme el Código Orgánico Integral Penal(COIP) en su Art. 246, con una sanción de pena privativa de libertad a fin de que se respete los derechos y principios consagrados en la Constitución de la República del Ecuador del 2008, donde se establece la responsabilidad en el manejo de la naturaleza por parte del Estado, por lo que la misma prescribe el Derecho de Repetición para que respondan por sus acciones y omisiones por eso la responsabilidad recae en todas las instituciones del sector público y en general en todos los ciudadanos que vivimos en el territorio ecuatoriano.
