Abstract
La presente investigación jurídica, consta de siete capítulos distribuidos de la siguiente manera:
En el capítulo I, se puede encontrar la determinación del problema de investigación, los objetivos, las variables y los recursos empleados.
El capítulo II contiene el Marco teórico donde se puede revisar la fundamentación de la investigación acerca del derecho de repetición y las contravenciones de tránsito, dividida en cuatro apartados donde consta la doctrina, la jurisprudencia, la legislación y el Derecho comparado.
El capítulo III constituye un estudio estadístico de impugnaciones a citaciones resueltas durante el año 2013 en el Juzgado Segundo Provincial de tránsito de Los Ríos.
El Capítulo IV establece la metodología utilizada tanto en la investigación como en el trabajo de campo aplicado. El Capítulo V Comprende el análisis e interpretación del trabajo de campo realizado, así como la comprobación de la hipótesis planteada; En el capítulo VI constan las conclusiones y recomendaciones; y,
El capítulo VII contiene la propuesta de reforma de ley planteada como solución al problema de investigación, ante la falta de norma que permita ejercer la acción de repetición contra agentes de tránsito por emisión de citaciones sin elementos probatorios de ley.
Description
The present investigation, has seven chapters distributed in the following way:
In the chapter I, it can be the determination of the investigation problem, the objectives, the variables and the used resources.
The chapter II the theoretical Marco contains where you can revise the foundation of the investigation about the repetition right and the traffic breaches, divided in four sections where it consists the doctrine, the jurisprudence, the legislation and the compared Right.
The chapter III consist a statistical study of objections to resolved citations during the year 2013 in the Tribunal Provincial Second of traffic of The Ríos.
The Chapter IV establish the used methodology as much in the investigation as in the work of applied field. The Chapter V Understands the analysis and interpretation of the work of carried out field, as well as the confirmation of the outlined hypothesis; In the chapter I SAW they consist the conclusions and recommendations; and,
