| dc.description | The issue raised in this research: "Human rights and legal innovation of the Right to Resistance", was developed to fulfill the different methodological points, in accordance with the resolutions taken by the State Technical University Quevedo and the Council Board of the Faculty of Law. The thesis consists of six chapters in which a conceptualization of the subject is performed: the introduction, the problematization, formulation and definition of the problem is noted; in justifying the importance of this issue is highlighted; the general and specific objectives, hypothesis that the variables listed are developed; resources, human, material and budget. In the theoretical framework summarizes the history of the research is done, the foundation, doctrine, jurisprudence, law and comparative law develops concerning the question asked. In developing the methodology used methods, fieldwork conducted through surveys and interviews and instruments used are described. The fieldwork allowed to have a database that were interpreted and analyzed for verification of the hypothesis and the research report. Based on the findings and recommendations objectives are identified and finally the proposal in which a training proposal concerning Human Rights operators develops justice is done. | es_ES |
| dc.description.abstract | El tema planteado en el presente trabajo de investigación: “Los Derechos Humanos y la innovación jurídica del Derecho a la Resistencia”, se desarrolló cumpliendo los diferentes puntos metodológicos, de conformidad a las resoluciones tomadas por la Universidad Técnica Estatal de Quevedo y, el Consejo Directivo de la Facultad de Derecho. La tesis de grado está compuesta de seis capítulos en los cuales se realiza una conceptualización del tema: Se señala la introducción, la problematización, formulación y delimitación del problema; en la justificación se resalta la importancia de realizar éste tema; se señalan los objetivos general y específicos, hipótesis de la cual se desarrollan las variables; los recursos, humanos, materiales y presupuesto. En el marco teórico se realiza una síntesis de los antecedentes de la investigación, se desarrolla la fundamentación, doctrina, jurisprudencia, legislación y derecho comparado referente al tema planteado. En el desarrollo de la metodología se describen los métodos utilizados, el trabajo de campo realizado mediante encuestas y entrevistas y los instrumentos utilizados. El trabajo de campo permitió contar con un banco de datos que fueron interpretados y analizados para realizar la comprobación de la hipótesis y el reporte de la investigación. En base a los objetivos se señalan las conclusiones y recomendaciones y, por último se desarrolla la propuesta en la cual se realiza una propuesta de capacitación referente a los Derechos Humanos a los operadores de justicia. | es_ES |
