| dc.description | This thesis entitled: "DEPENALIZATION OF OFFENSES OF BAGS AND BEGGINS ESTABLISHED IN THE CRIMINAL CODE, BECAUSE OF VIOLATION OF CONSTITUTIONAL RIGHTS". PROPOSAL: REFORM TO THE CHAPTER REGARDING THE BAITS AND BENDAGES TYPIFIED IN THE ARTS. 383, 384, 385. OF THE PENAL CODE, it deals in its Chapters: CHAPTER I.- Introduction, Justification, Problem Statement, Objectives, Hypothesis, and the variables. CHAPTER II.- The Theoretical Framework, which includes the Historical, Doctrinal, and Legal Framework. CHAPTER III.-The Methodology, Types of Investigation, Population, Sample, Instruments of the Investigation data collection, finding of the Investigation. CHAPTER IV.- The Analysis and interpretation of the results, through surveys directed to the citizenship of Cantón la Maná, Lawyers in the free Exercise, and officials of the Public Ministry; The verification of the hypothesis. CHAPTER V. - The Conclusions and Recommendations. CHAPTER VI.- The Proposal, Bibliography and Annexes. According to the results of the field investigation, it is clear that the generalized criterion of Legal Professionals and citizens in general, is that decriminalize the crimes of vagrants and beggars typified in the Penal Code, since their acts do not have any danger to society; On the contrary, according to the Constitution of the Republic and international instruments, they require protection by the State. | es_ES |
| dc.description.abstract | La presente tesis titulada: “DESPENALIZACIÓN DE DELITOS DE VAGOS Y MENDIGOS ESTABLECIDOS EN EL CÓDIGO PENAL, POR VIOLACIÓN A LOS DERECHOS CONSTITUCIONALES”.PROPUESTA: REFORMA AL CAPÍTULO REFERENTE A LOS VAGOS Y MENDIGOS TIPIFICADOS EN LOS ARTS. 383, 384, 385. DEL CÓDIGO PENAL, trata en sus Capítulos: CAPÍTULO I.- Introducción, Justificación, Planteamiento del problema, Objetivos, Hipótesis, y las variables. CAPÍTULO II.- El Marco Teórico, que comprende del Marco Histórico, Doctrinario, y Jurídico. CAPÍTULO III.-La Metodología, Tipos de Investigación, Población, Muestra, Instrumentos de la Investigación recolección de datos, hallazgo de la Investigación. CAPÍTULO IV.- El Análisis e interpretación de los resultados, mediante encuestas dirigidas a la ciudadanía del Cantón la Maná, Abogados en el libre Ejercicio, y funcionarios del Ministerio Público; La comprobación de la hipótesis. CAPÍTULOV.-Las Conclusiones y Recomendaciones. CAPÍTULO VI.- La Propuesta, Bibliografía y Anexos. Según los resultados de la investigación de campo, se desprende que el criterio generalizado de los Profesionales del Derecho y de la ciudadanía en general, es que se despenalice los delitos de vagos y mendigos tipificados en el Código Penal, por cuanto sus actos no revisten ningún peligro para la sociedad; por el contrario, según la Constitución de la República y los instrumentos internacionales, requieren protección por parte del Estado. | es_ES |
