| dc.description | The present research aims to make amendments to the second paragraph of Article Sixteen Reform Act Title V, Book II of the Childhood and Adolescence Code, and introduce a clear and equitable rule allowing additional fixing alimony not violating constitutional rights of the obligor as much as the other holders who have not exercised their right to applying for alimony payments through courts, even though our country has adopted the figure of State Constitutional Rights and Justice, professing the same rank rights, many infra constitutional rules are not consistent with the constitutional text, and therefore are not effective when securing the rights. This research was conducted in the six chapters, Chapter is making the problem to be generally known, such as: the boundary, the importance of law, the objectives and the resources needed to conduct the research; In Chapter II, are search background, a doctrinaire, jurisprudence, and normative study, comprising the theoretical framework was performed, Chapter III which determines the methods, techniques and tools used for the development of this research was performed, Chapter IV is the analysis and interpretation of the results of the interviews, surveys corroborate the hypothesis in this paper, Chapter V issues my recommendations and conclusions based on a research conducted, and Chapter VI shows the reform proposals in which additionally creates equally fixed alimony, and consequently cease the violation of constitutional rights. | es_ES |
| dc.description.abstract | El presente Trabajo de Investigación tiene como fin realizar reformas al numeral segundo del artículo dieciséis de la Ley Reformatoria al Título V, Libro II del Código de la Niñez y la Adolescencia, e introducir una norma clara y equitativa que permita una fijación de pensiones alimenticias adicionales que no vulneren derechos constitucionales para el alimentante como los demás derecho habientes que no han ejercido su derecho a solicitar el pago de una pensión alimenticia por vía judicial, pese a que nuestro país a adoptado la figura de Estado Constitucional de Derechos y Justicia, prescribiendo la igual jerarquía de los derechos. Muchas normas infra constitucionales no están acordes al texto constitucional, y por lo tanto no son eficaces al momento de garantizar los derechos. La presente investigación comprende seis capítulos, el Capítulo I da a conocer en forma general el Problema, su delimitación, la importancia, los objetivos, así como los recursos que se necesitó para realizar la investigación. El Capítulo II, además de los antecedentes de la Investigación, contiene un estudio doctrinario, jurisprudencial, y normativo, que comprende el Marco Teórico. En el Capítulo III, se determina los Métodos, Técnicas e Instrumentos utilizados para el desarrollo de la presente investigación. El Capítulo IV, hace el análisis e interpretación de los Resultados de las entrevistas, encuestas que corroboran la hipótesis planteada en el presente trabajo. En el Capítulo V, emito mis Conclusiones y Recomendaciones en base a la investigación realizada. En el Capítulo VI, plasmo la Propuesta de reforma con lo cual se fijará pensiones alimenticias adicionales de forma equitativa, y consecuentemente cesará la violación de Derechos Constitucionales. | es_ES |
