| dc.description | This research entitled Doctrinal argumentation of the Constitutional and Legal Guardianship in Homoafectivas Unions, it is aimed to strengthen and reduce high rates of discrimination based on sexual orientation manifested in Ecuador, using doctrinal and jurisprudential media about the rights of homo family affective; why this research has a preventive approach to doctrinal and legal reasoning of the constitutional protection in homoafectivas unions, with its respective proposal. The theoretical framework of this research seeks to argue doctrinal and legally the constitutional protection in homoafectivas unions, in order to reduce the violation of the rights and guarantees estatuidas in the law and the constitution in favor of homosexuals and other members of the LGBTI groups who want or crave form and establish families homoafectivas allowed by legal ties and guaranteed by the law and the doctrine of our country. The design of this research is descriptive and field. The sample was composed by LGBTI groups existing in the town of Ventanas Canton. The list of questions was based on determining the causes or legal reasons that LGBTI groups do not exercise their right to establish free unions established in the Constitution and also constitute homoafectivas families. In conclusion the result is having achieved teach and disseminate jurisprudence, treaties and other documents and laws that benefit this group of people to lower high indicies of discrimination because of sexual orientation and homoafectivas unions. | es_ES |
| dc.description.abstract | La presente investigación titulada Argumentación Doctrinal y Jurídica de la Tutela Constitucional en las Uniones Homoafectivas, ésta dirigida a fortalecer y a disminuir las altos índices de discriminación por causa de orientación sexual manifiesta en el Ecuador, utilizando medios doctrinarios y jurisprudenciales sobre los derechos de las familia homo afectivas; razón por la que esta investigación tiene un enfoque preventivo sobre la argumentación doctrinal y jurídica de la tutela constitucional en la uniones homoafectivas, con su propuesta respectiva. El marco teórico de esta investigación busca argumentar doctrinaria y jurídicamente la Tutela Constitucional en las uniones homoafectivas, con el fin de disminuir la violación de los derechos y garantías estatuidas en la ley y la constitución a favor de los homosexuales y demás miembros de los grupos GLBTI, que desean o anhelan formar y establecer familias homoafectivas con vínculos legales permitidos por y garantizados por la ley y la doctrina de nuestro país. El diseño de esta investigación es de tipo descriptiva y de campo. La muestra estuvo conformada por los grupos GLBTI, existentes en la localidad del Cantón Ventanas. El cuestionario de preguntas se basó en determinar las causas o razones jurídicas por las que los grupos GLBTI, no ejercen sus derechos de establecer uniones libres establecidas en la Constitución y a además constituir familias homoafectivas. Como conclusión el resultado obtenido es haber logrado impartir y difundir doctrina jurisprudencial, tratados y demás documentos y leyes que benefician a este grupo de personas a fin de disminuir los altos indicies de discriminación por causa de orientación sexual y uniones homoafectivas. | es_ES |
