| dc.description | This Thesis legal research entitled "DISAPPEARANCE OF PERSONS AND THE ENFORCEMENT GUARANTEED BY THE STATE" establishes a study on the need for the law of the land is consistent with the requirements of the social order, to the effect that the State fulfill its duty to ensure safety for people and the full exercise of their rights and fundamental freedoms, it determined the relevance of a proposal for the legal reform to Art. 84 of the Penal Code of Integral. | dc.description.abstract | La presente Tesis de investigación jurídica intitulada “DESAPARICIÓN FORZADA DE PERSONAS Y LA TUTELA EFECTIVA GARANTIZADA POR EL ESTADO” establece un estudio acerca de la necesidad de que el orden jurídico del país sea coherente con los requerimientos del orden social, a efecto de que el Estado cumpla con su deber de garantizar seguridad a las personas y el pleno ejercicio de sus derechos y libertades fundamentales, el mismo que determinó la pertinencia de plantear una propuesta de reforma jurídica al Art. 84 del Código Orgánico Integral Penal. La Tesis se estructuró en seis capítulos. El Primero aborda el Problema. El Segundo el Marco Teórico, El Tercero la Metodología de la investigación. El Cuarto capítulo el Análisis e Interpretación de Resultados. El Quinto las Conclusiones y Recomendaciones y el Sexto la Propuesta.
