Abstract
Este trabajo de Investigación, pretende argumentar y plantear la necesidad de una reforma a la Ley, para que los gobiernos Provinciales obtengan la competencia y sean quienes recauden los Impuestos por concepto de predios rurales y no los GAD Municipales como lo realizan hasta el día de hoy.
Esta Investigación jurídica está estructurada en los siguientes capítulos:
En el primer capítulo, trata la parte principal para el conocimiento del problema, y para el efecto fue necesario plantear la hipótesis de investigación.
El segundo capítulo, hace referencia al marco teórico, en los aspectos histórico, doctrinario y jurídico.
El tercer capítulo, describe la metodología utilizada en la investigación que nos ocupa; los métodos aplicados, los tipos de investigación, la población, las muestras las técnicas e instrumentos utilizados en la recolección de datos.
El cuarto capítulo, se comprueba la hipótesis a través de los resultados de la investigación obtenidos mediante entrevistas a autoridades competentes en la Ciudad de Vinces, además de las encuestas realizadas a los abogados en libre ejercicio profesional.
El quinto capítulo, describe las conclusiones y recomendaciones.
Finalmente el sexto capítulo, habla de la propuesta, de los beneficiarios y del impacto social.
Description
This research aims to argue and raise the need for a reform of the Act, that the provincial governments are obtaining competition and who collect the tax in respect of rural land and no municipal GAD as made until today.
This legal research is divided into the following chapters:
In the first chapter, is the main part for understanding the problem, and for this purpose it was necessary to hypothesize research.
The second chapter refers to the theoretical framework, historical, doctrinal and legal aspects.
The third chapter describes the methodology used in the investigation at issue; the methods used, the types of research, people, samples of techniques and instruments used in data collection.
The fourth chapter, the hypothesis is tested through the research results obtained through interviews with relevant authorities in the City of Vinces, plus surveys of lawyers in free practice.
The fifth chapter describes the conclusions and recommendations.
Finally the sixth chapter discusses the proposal, beneficiaries and social impact.
