Abstract
La presente tesis de grado cuyo tema es “El divorcio por el estado de salud de los cónyuges, vulnera los principios constitucionales”, tuvo como objetivo plantear una propuesta de reforma al Art. 110 numeral 8 del Código Civil, se realizó el plan de tesis según lametodología y las disposiciones reglamentarias establecidas por la Universidad Técnica Estatal de Quevedo y Facultad de Derecho.
La selección del material bibliográfico, permitió realizar el marco teórico en sus aspectos histórico, doctrinario jurídico y jurisprudencial, además derecho comparado del tema investigado. La investigación de campo; determina la necesidad de reformar el art. 110 numeral 8 del Código Civil.
Se realizó encuestas a los ciudadanos y ciudadanas y abogados en libre ejercicio profesional del Cantón Quevedo y entrevista, al Juez 8vo de lo Civil del cantón La Maná, con los datos obtenidos se llegó a determinar la necesidad de reformar el art. 110 numeral 8 del Código Civil.
Se describe la metodología; las conclusiones y recomendaciones. La propuesta describe algunos aspectos en la cual se realiza la exposición de motivos por los cuales es necesario reformar el art.110 numeral 8vo del Código Civil

This thesis whose subject is "Divorce for the health of the spouses, violates the constitutional principles ", aimed to present a proposed amendment to Article 110 paragraph 8 of the Civil Code, the thesis plan was made according to the methodology and regulations established by the State Technical University of Quevedo and Law.
The selection of reading material, allowed for the theoretical framework in their historical, legal and jurisprudential doctrine also compared aspects of the topic right field research investigated; determines the need to reform the art. 110 Section 8 of the Civil Code.
Surveys of citizens and lawyers was held in free practice and Quevedo Canton interview, the 8th Civil Court of the Canton La Maná , with the data obtained was not determined the need to reform the art. 110 Section 8 of the Civil Code.
The methodology described the conclusions and recommendations.
The proposal describes some ways in which the statement of reasons why it is necessary to reform the 8th paragraph of the Civil Code Art.110 is performed
