Abstract
La presente investigación jurídica, cuyo objetivo fue plantear una propuesta de reforma al Art. 2232 inciso tercero del Código Civil, se realizó siguiendo las disposiciones reglamentarias establecidas por la Universidad Técnica Estatal de Quevedo.
La selección del material bibliográfico, me permitió realizar un análisis histórico, doctrinario y jurídico de tema y formular la hipótesis a fin de orientar la investigación de campo.
En el desarrollo del marco teórico, mediante los antecedentes, fundamentación, doctrina, Jurisprudencia, Legislación y Derecho Comparado, se hizo un estudio jurídico en el cual se determina la necesidad de reformar el inciso tercero del art. 2232 del Código civil.
En la Investigación de campo a base de encuestas a los ciudadanos y ciudadanas del cantón La Maná y entrevista, a un Juez Civil y Mercantil, con las base de datos obtenidas se llegó a determinar la necesidad de reformar el art. 2232 inciso tercero del Código Civil.
La metodología y el diseño de la investigación, me permitió obtener información con la cual procedí a desarrollar la propuesta en la cual se realiza la exposición de motivos por los cuales es necesario reformar el art. 2232 inciso tercero del Código Civil.
Se detallan las conclusiones, recomendaciones, bibliografía y anexos
Description
This legal research, which aimed to raise a proposed amendment to the third paragraph of Article 2232 Civil Code, was performed following the regulations established by the State Technical University Quevedo.
The selection of reading material, I allowed a historical analysis, and legal doctrine hypothesize topic and to guide the field research.
In developing the framework, using the background, rationale, doctrine, Case Law, Legislation and Comparative Law, it became a law in which we determine the need to reform the third paragraph of Art. 2232 of the Civil Code.
In the field research based on surveys of citizens of Canton La Maná and interview, a Civil and Commercial Court, the database obtained was not determined the need to reform the art. Third paragraph 2232 of the Civil Code.
The methodology and research design allowed me to obtain information which proceeded to develop the proposal which is performed by the preamble which is necessary to reform the art. Third paragraph 2232 of the Civil Code.
