Abstract
El desarrollo de la presente tesis de grado en la cual se planteó como tema: “La reparación del daño moral por efecto del despido intempestivo”, cuyo objetivo fue presentar una propuesta de reforma al artículo 188 del Código del Trabajo, la misma que se realizó cumpliendo el plan de tesis y sus puntos metodológicos aprobados por el Consejo Directivo de la Facultad de Derecho de la Universidad Técnica Estatal de Quevedo.
En la introducción, problematización, justificación se señala la importancia del tema, el objetivo general, los específicos y la hipótesis que sirvieron para guiar la investigación, Se procedió a seleccionar el material bibliográfico a fin de tener un banco de datos y material suficiente para realizar el análisis teórico, histórico, fundamentación, doctrinario, jurídico, legislación nacional e internacional, jurisprudencial y Derecho comparado, cuyo objeto de estudio es el Código del Trabajo, art. 188 referente al despido intempestivo.
Los métodos utilizados permitieron realizar el trabajo de campo, mediante encuestas y entrevistas, datos con los cuales fue posible comprobar la hipótesis.
Se desarrollaron las conclusiones y recomendaciones donde se resalta la de reformar el art. 188 del Código del Trabajo, por lo cual se realizó el desarrollo de la propuesta en la cual se hizo una exposición de motivos y se fundamentó las bases jurídicas de la reforma al art. 188 del Código del Trabajo

The development of this thesis in which he raised the theme: " The moral damage compensation for unfair dismissal effect " whose objective was to present a proposal to amend Article 188 of the Labour Code, the same held fulfilling the thesis plan and methodological points approved by the Governing Board of the Faculty of Law of the State Technical University of Quevedo.
In the introduction, problem, justification noted the importance of the subject, the general objective, specific and assumptions that were used to guide the research, We proceeded to select bibliography to take a data and material sufficient to perform theoretical, historical, foundation, doctrinal, legal analysis, national and international law jurisprudence and comparative law, whose object of study is the Labour Code, Art. 188 relating to unfair dismissal.
The methods used allowed for fieldwork, through surveys and interviews, data with which it was possible to test the hypothesis.
The conclusions and recommendations which highlights the art of reform were developed. 188 of the Labour Code, so the development of the proposal in which an explanatory statement was made and the legal basis for the reform of art was based was performed. 188 of the Labour Code
