Abstract
La presente investigación jurídica, la cual es un requisito previo a la obtención del Título de abogado de los Tribunales y Juzgados de la República del Ecuador, tiene como objetivo principal el incumplimiento del empleador con el pago oportuno de la bonificación por desahucio, para lo cual he planteado la reforma al artículo 185 del Código del Trabajo, debido a las constantes violaciones a los derechos de los trabajadores, me motivó a realizar el presente tema.
Se realizo un análisis científico, doctrinario jurídico y de derecho comparado del tema y del problema planteado, para lo cual señale las causas y consecuencias, el mismo que me permitió justificar plenamente el desarrollo del tema.
Los objetivos planteados (general y específicos) en la presente investigación se alcanzaron en su totalidad, los cuales me permitieron realizar la hipótesis y determinar las variables, los recursos utilizados en el campo personal, resalto la importancia y guía proporcionada por el director de tesis, los materiales utilizados y el presupuesto económico fueron determinantes para el desarrollo normal de la presente investigación
El Trabajo de campo realizado mediante encuestas realizadas a los ciudadanos y ciudadanas del Cantón Quevedo determinó
Los métodos aplicados fueron el deductivo, histórico comparativo, investigación cualitativa y cuantitativa, los cuales sirvieron para realizar con profunda objetividad el problema planteado.
El desarrollo de la propuesta establece la reforma al artículo 185 del Código del Trabajo para beneficio del trabajador ya que siendo el trabajo a fin de establecer los beneficios que por derecho le corresponden al trabajador, ya que siendo el trabajador un bien social éste debe mantenerse para generar riqueza y bienestar de la empresa y a las familias del trabajador.
Description
The present legal investigation, which is a prerequisite to obtaining the title of lawyer of the Courts and Courts of the Republic of Ecuador, has as main objective the employer's failure to pay the eviction bonus, for which I have proposed the reform of Article 185 of the Labor Code, due to the constant violations of the rights of workers, motivated me to carry out the present topic.
A scientific analysis, legal doctrine and comparative law of the subject and the problem was made, for which it points out the causes and consequences, the same that allowed me to fully justify the development of the topic.
The objectives set (general and specific) in the present investigation were reached in their entirety, which allowed me to make the hypothesis and determine the variables, the resources used in the personal field, highlight the importance and guidance provided by the thesis director, the materials used and the economic budget were decisive for the normal development of the present investigation
The fieldwork carried out through surveys carried out on the citizens of Cantón Quevedo determined
The applied methods were the deductive, comparative historical, qualitative and quantitative research, which served to realize with deep objectivity the problem posed.
The development of the proposal establishes the reform of Article 185 of the Labor Code for the benefit of the worker since the work in order to establish the benefits that by right correspond to the worker, since the worker being a social good must be maintained for generate wealth and welfare of the company and the families of the worker.
