Abstract
La presente trabajo de investigación lo realizo cumpliendo con el pensum de estudios de la Facultad de Derecho esperando sea un aporte técnico –científico de los aspectos jurídicos inherentes al problema de la ocurrencia de delitos múltiples y su relación con la impericia y la falta de formación técnica de la población en general, con este objetivo, se analizó la Constitución de la República del Ecuador, la Ley Orgánica de Transporte Terrestre, Tránsito y Seguridad Vial, la Ley Orgánica de Educación Superior y la Ley de Educación Intercultural, normativas que hacen referencia a la obligatoriedad de la formación en Educación Vial en los planteles educativos de todos los niveles, cooperativas y compañías de transporte y ciudadanía en general.
Este trabajo investigativo contiene, el planteamiento del problema, la justificación, los objetivos la hipótesis. Seguidamente se desarrolla el marco teórico donde se realiza un estudio histórico, doctrinario y jurídico del tema, se complementa con la investigación de campo a base de encuestas y entrevistas lográndose comprobar la hipótesis de la investigación.
Finalmente en base a los resultados obtenidos de la investigación se elabora una propuesta que es la reforma a la Ley Orgánica de Transporte Terrestre, Tránsito y Seguridad Vial en lo relacionado a la aplicación de incentivos para conductores y peatones que participen en formación técnica obteniendo la máxima calificación en la materia de Educación Vial y conseguir que la ciudadanía tome conciencia y considere la importancia de la preparación técnica en materia de tránsito.
Description
This research work is carried out by complying with the curriculum of the Faculty of Law, hoping it will be a technical-scientific contribution of the legal aspects inherent to the problem of the occurrence of multiple crimes and their relationship with the lack of technical training and lack of training. of the population in general, with this objective, the Constitution of the Republic of Ecuador, the Organic Law of Land Transportation, Traffic and Road Safety, the Organic Law of Higher Education and the Law of Intercultural Education, regulations that make reference to the obligatory nature of the Education in Road Education in the educative establishments of all the levels, cooperatives and companies of transport and citizenship in general.
This investigative work contains, the approach of the problem, the justification, the objectives the hypothesis. Next, the theoretical framework is developed, where a historical, doctrinal and juridical study of the subject is carried out. It is complemented with field research based on surveys and interviews, thus verifying the hypothesis of the investigation.
Finally, based on the results obtained from the research, a proposal is prepared that is the reform of the Organic Law of Land Transportation, Traffic and Road Safety in relation to the application of incentives for drivers and pedestrians participating in technical training, obtaining the maximum qualification in the matter of Road Education and getting the citizenship to become aware and consider the importance of the technical preparation in the matter of transit.
