Abstract
El presente trabajo de investigación jurídica, se lo realiza con el objeto de presentar una propuesta jurídica para reformar el Art. 57 literal f del Código Orgánico de Organización Territorial Autonomía y Descentralización ya que se le está quitando atribuciones al Órgano Legislativo y dando atribución para aprobar estos manuales solo al Ejecutivo para no generar contradicción al momento de la aprobación del Orgánico Funcional y Por Procesos, ya que debe ser un solo ente el que lo apruebe debido a que no existe una jerarquización entre la normativa municipal y Ley Orgánica de Servicio Público donde de acuerdo al Art. 56 inciso último debe ser sometido al respectivo Órgano Legislativo para la aprobación de estos manuales, por lo que se debe plantear una reforma que no cause separación entre estas normas.
Esta Investigación jurídica está estructurada en seis capítulos. En el PRIMER CAPÍTULO, se trató la parte principal para el conocimiento del Problema y para el efecto, fue necesario plantear la hipótesis de que la solución al problema estaba en el cumplimiento de la hipótesis planteada en la investigación. El SEGUNDO CAPÍTULO, hace referencia al Marco Teórico, en los aspectos: Histórico, doctrinario y jurídico. En el TERCER CAPÍTULO se describe la Metodología utilizada en la investigación que ocupa; los métodos aplicados, los tipos de investigación, la población, las muestras las técnicas e instrumentos utilizados en la recolección de datos. En el CUARTO CAPÍTULO, se comprueba la Hipótesis a través de los resultados de la investigación obtenidos mediante entrevistas a autoridades competentes con sede en el cantón Valencia, además de las encuestas realizadas a los abogados en libre ejercicio profesional. El QUINTO CAPÍTULO, describe las Conclusiones y Recomendaciones sobre la solución de los conflictos de índole jurídico que pueden ser solucionados mediante la mediación. Finalmente el SEXTO CAPÍTULO, presenta la exposición de motivos y razones que fundamentan la Propuesta del problema planteado. Y por último la Bibliografía, que es la recopilación de diversos autores que sustentan la hipótesis planteada.

This work of legal research, I made in order to present a legal proposal to amend Art. 57 paragraph f of the Code of Organization Territorial Autonomy and Decentralization as it is being removed allocations Legislature and giving authority to approve These manuals only the Executive in order to avoid conflict at the time of approval of the Organic Functional and by process, since it must be a single entity which approval because there is no hierarchy between the municipal regulations and Law on Public Service where according to Art. 56 last paragraph must be submitted to the respective legislative body for approval of the manuals, so we should propose a reform that will not cause separation between these standards.
This legal research is divided into six chapters. In the first chapter, the main part for understanding the problem and the effect was treated, it was necessary to hypothesize that the solution to the problem was in compliance with the research hypothesis. The second chapter refers to the Theoretical Framework in aspects: historical, doctrinal and legal. In the third chapter the methodology used in the investigation at issue described; the methods used, the types of research, people, samples of techniques and instruments used in data collection. In the fourth chapter, the hypothesis is tested through the research results obtained through interviews with relevant authorities based in the canton Valencia, in addition to surveys of lawyers in free practice. The fifth chapter describes the conclusions and recommendations on the resolution of conflicts of a legal nature that can be solved through mediation. Finally the sixth chapter presents the grounds and reasons for the Proposal of the problem. And finally the bibliography, which is the collection of various authors that support the hypothesis
