Abstract
La prescripción es el modo de adquirir el dominio de una cosa, mediante el transcurso de cierto tiempo y bajo las condiciones señaladas en la Ley, por lo tanto constituye el mecanismo por el cual se podrá adquirir en forma legal la propiedad de un bien inmueble. Al respecto el Código Civil en el artículo 2410 al referirse a la prescripción extraordinaria adquisitiva de dominio manifiesta: el dominio de las cosas comerciales que no han sido adquiridas por la prescripción ordinaria pueden serlo por la extraordinaria, bajo las reglas que van a expresarse”, esto es que tenga la posesión material del predio por más de quince años con el ánimo de señor y dueño, sin que persona o autoridad alguna haya obstruido o pretendido despojarla de la posesión, sin embargo antes de que medie la sentencia, luego de la cual se le confiere la titularidad del bien inmueble por el transcurso del tiempo, según el análisis de las disposiciones legales aplicables a esta materia, el legítimo prescriptor debe tener, aparte de lo establecido en el Código Civil, la oportunidad de recobrar el dominio; esto es, sin violencia ni clandestinidad, a través de una mediación extrajudicial o concordada con el Juez y el demandante antes que se declare la prescripción en favor del prescribiente, fallo que solo sea necesario obtener cuando fracase dicha mediación, entonces se podrá proseguir con el litigio judicial contra alguien que reclame su posesión sin desconocer su derecho.
