Abstract
El presente trabajo de investigación jurídica, se lo realiza con el objetivo de fundamentar jurídicamente una norma en la Ley Notarial que establezca la disposición mediante la cual los Notarios deban exigir o no la comparecencia de testigos cuando una persona adulta mayor desea realizar un trámite notarial, aun cuando estos se hallen lúcidos mentalmente y tengan una preparación académica necesaria, motivo por el cual he planteado el presente proyecto de investigación, por ello al Realizar esta investigación nos encontramos en la necesidad de conocer la evolución histórica, definiciones notariales, y estudios del derecho notarial. También analizamos los métodos a utilizarse en la investigación, técnicas e instrumentos de la investigación, validez y confiabilidad de los instrumentos, y procesamiento de datos, preguntas realizadas a personas encuestadas, Notarios y abogados en libre ejercicio tanto dentro del cantón Quevedo, como fuera de él.-

This legal research work , I performed in order to legally justify a provision in the Notary Law establishing the arrangement whereby Notaries should require or not the appearance of witnesses when an elderly person wants to perform a notarial process , even when the latter are mentally lucid and academic preparation are necessary , why I raised this research project, for it to carry out this research we are in the need to know the historical evolution , definition notary and legal studies notarial.
